1. Contact Details, Scope

1.1. Our contact details are as follows:

Contact details of the company's Data Protection Officer:

1.2. These General Terms and Conditions apply to events offered by us, whether in our own name or on behalf of another event organiser. They apply to both individual tickets and subscriptions.

1.3. Should additional general terms and conditions be incorporated into the contract, in particular those of another event organiser, these General Terms and Conditions shall take precedence over any conflicting terms in the event of a discrepancy.

1.4. In addition to these General Terms and Conditions, the house rules applicable at the venue shall apply. In the event of any conflict, these General Terms and Conditions shall take precedence over the house rules.

2. Contracting Parties, Services

2.1. Where we sell tickets not as event organiser in our own name but on behalf of another event organiser, we act solely as that organiser's agent. In such cases, the rights and obligations arising from the event contract are established between the respective event organiser and the customer. Any claims by the customer arising from the event contract (e.g. regarding the staging of the event, cancellation, postponement, etc.) are therefore to be directed to the event organiser, not to us. We have been engaged by the event organiser to carry out and process the sale of tickets (including order processing, dispatch of tickets, payment processing, etc.). The event organiser remains the contracting party. For the expeditious resolution of any queries or issues, customers are requested to contact us in the first instance.

2.2. The event contract shall only confer entitlement to travel on public transport services where this is expressly stated in our ticket description or during the ordering process. Any contract of carriage is concluded solely between the customer and the transport operator; no claim against the event organiser for transportation shall arise.

3. Orders, Conclusion of Contract, Ballot

3.1. An order placed by the customer at a box office, by telephone, or via the online shop constitutes an offer to conclude an event contract, which shall be accepted by us, either in our own name or on behalf of another event organiser, in accordance with the provisions set out below.

3.2. Where an order is placed at a box office, the contract is concluded upon handover of the ticket to the customer.

3.3. Where an order is placed by telephone, the contract is concluded upon acceptance being declared by one of our members of staff during the call.

3.4. Where an order is placed via the online shop, the contract is concluded as follows: the customer selects the ticket they wish to purchase and adds it to their basket. After confirming that they have read and accepted these General Terms and Conditions, the customer is prompted via the "Proceed to Checkout" button to enter their personal details or to log in. The available payment methods and the contents of the basket are then displayed. After selecting a payment method, the customer is shown a summary of all order details. By clicking the "Buy Now" button, the customer submits their order and thereby makes an offer to conclude a contract. The event organiser's acceptance is communicated by e-mail.

Until the "Buy Now" button has been clicked, the order details may be amended or the purchase cancelled at any time. Order details may be amended either by using the browser's "Back" function or by navigating to the relevant stage of the ordering process via the basket system's individual buttons.

The specific text of the contract relating to the order is not stored. Prior to submitting the order, however, the customer has the opportunity to review the contract details, print them using the browser's print function, and save them. Order details may also be accessed at any time after purchase via the customer account.

3.5. Where tickets are allocated by ballot, for example due to high demand, an event contract shall only be concluded if the ballot participant has been selected to purchase a ticket and an event contract is subsequently entered into with them. The specific conditions of participation and the procedure for any ballot shall be set out in the respective terms of participation for that ballot.

Participation in the ballot is non-binding for the participant; no charge for participation in the ballot shall be levied by us or by any other event organiser.

No legal recourse shall be available in connection with the ballot. No rights may be derived solely from participation in the ballot.

Participation in the ballot is permitted only up to the maximum number of tickets specified. Participants who circumvent this rule — for example by providing different names — may be excluded from the ballot. The same applies to persons who are excluded from purchasing tickets for any other reason.

4. Price Components, Postage and Packaging, Payment Terms

4.1. The amount payable by the customer for tickets may exceed the prices printed on the tickets, as box offices may, for example, levy separate booking fees. Where handling and postage charges are applied in our online shop, these shall be displayed in the basket prior to the customer submitting their order, so that the total amount payable is clearly visible at all times. All prices stated in the online shop include the applicable statutory rate of value added tax.

4.2. Where tickets are dispatched by post, they shall be sent by standard mail. An additional handling fee, which includes postage costs, shall be charged for dispatch and shall be displayed during the ordering process prior to the customer submitting their order.

4.3. Depending on the event and the applicable ordering conditions, the customer may choose from various payment methods during the ordering process, which shall be displayed prior to the customer submitting their order. These may include, for example:

  • Cash payment (at box offices only)
  • Advance payment by bank transfer
  • Credit card (Visa, MasterCard / EuroCard)
  • Instant bank transfer

4.4. Where advance payment by bank transfer is selected, the total amount due must be transferred to the account specified by us by the date stated in our invoice. Ordered tickets shall only be dispatched upon receipt of payment in full.

4.5. Where an instant payment system (e.g. Sofort-Überweisung) is selected as the payment method, the customer shall be redirected either to the order summary page or to the website of the instant payment system provider, where the relevant selection or entry of personal details is to be completed.

4.6. We and the event organiser reserve the right to restrict the available payment methods on a case-by-case basis to one or more specific methods.

5. Due Date, Retention of Title, Chargebacks

5.1 The purchase price shall become due immediately upon conclusion of the contract, unless otherwise communicated by us or the event organiser (e.g. in the case of advance payment by bank transfer).

5.2. Tickets shall remain the property of the event organiser until payment has been received in full.

5.3. Should a credit card payment be subject to a chargeback, the customer shall be liable to reimburse all costs arising from the chargeback, including in particular any third-party charges such as those levied by the banks involved. Any further claims by the event organiser arising from the customer's default or non-payment shall remain unaffected. In order to avoid the costs associated with chargebacks, customers are requested not to dispute a debit in the event of a withdrawal from the purchase contract, a return, or a complaint, but instead to contact us to arrange the reversal of payment.

6. Delivery, Transfer of Risk

6.1. Tickets shall either be handed to the customer directly on site, dispatched upon request, or made available as digital tickets (e.g. mobile tickets or tickets sent by e-mail for printing). Tickets may only be dispatched up to 10 days before the respective event. Where a ticket contains a barcode, only its first use shall confer entitlement to admission, regardless of whether it is presented as a printed original or in digital form. It is the customer's responsibility to protect their online shop account, printed ticket, or digital ticket against unauthorised access by third parties. Where a ticket does not contain a barcode, only the first printout presented to the admissions staff shall confer entitlement to admission. Any copies or reprints of such tickets are made entirely at the customer's own risk.

6.2. Where tickets are dispatched at the customer's request, the risk of accidental destruction, loss, or accidental deterioration shall pass to the customer as soon as the tickets have been handed over to the postal or delivery service by the event organiser or by us acting as their agent. The choice of postal or delivery service shall be made by us.

6.3. Where tickets are held for the customer at a box office or at the door at the customer's request, they may only be collected during opening hours.

7. Maximum Order Quantity, Contractual Penalty

7.1. Each customer may order no more than the maximum quantity of tickets specified, regardless of the number of separate orders placed. Any circumvention of this restriction, for example by providing different names, is prohibited.

7.2. In the event of a breach of this prohibition, the event organiser shall be entitled to withdraw from any event contracts concluded by the customer for that event in excess of the maximum quantity (e.g. by cancelling the relevant tickets). Where multiple contracts were concluded simultaneously, the event organiser shall have the right to choose from which contracts to withdraw. The customer shall furthermore be liable to pay a contractual penalty to the event organiser, the amount of which shall be determined by the event organiser at its reasonable discretion and which may be reviewed by the competent court in the event of a dispute, provided that it shall not exceed five times the value of the tickets to which the withdrawal relates. Where the customer is entitled to a refund as a result of the withdrawal, the event organiser may offset this against the contractual penalty. Any other contractual penalties shall be taken into account when determining the amount of the penalty. Claims for damages by the event organiser shall remain unaffected, with contractual penalties being credited against any claims for damages arising from the same set of circumstances.

8. Additional Provisions for Subscriptions

8.1 A subscription is valid for the selected series within the selected concert season. It shall renew automatically for a further season unless cancelled in writing by the customer or the event organiser before the end of the current (or renewed) season. The notice period applicable shall be as set out in the subscription description.

8.2. In the event of a breach of the provisions set out in Clauses 9.6 and 9.10 (unauthorised transfer and failure to disclose the recipient's identity) and Clause 10.1 (purchase under a false or third-party name), the event organiser shall be entitled to terminate the subscription for cause with immediate effect.

8.3. Where the customer is unable to attend an event in their subscription series, the event organiser may, provided the customer waives their right of attendance, offer a voucher in lieu. The customer shall have no entitlement to such an exchange. The voucher may be redeemed, subject to availability and by agreement with the event organiser, for a ticket to another event during the same concert season. Where the selected ticket is priced higher than the pro-rata subscription price attributable to the missed event, the customer shall be required to pay the difference.

8.4. Should an event within a subscription series be cancelled, the event organiser may either refund the pro-rata subscription price attributable to the cancelled event or offer the customer a voucher in lieu. The provisions of Clause 8.3, sentences 3 and 4 shall apply to the redemption of such a voucher.

9. Entitlement to Attend Events, Assumption of Contract, Name Entry on Ticket, Prohibition on Resale and Transfer, Consequences of Breach, Contractual Penalty

9.1. The event organiser has a legitimate interest in preventing the resale of tickets at inflated prices and in guarding against the risk of criminal offences in connection with attendance at its events. The following provisions therefore apply to the use and transfer of tickets.

9.2. Entitlement to attend an event exists solely on the basis of an event contract concluded by the attendee with the event organiser, or one into which the attendee has assumed in accordance with the conditions set out in Clause 9.4. A further condition of attendance is that the attendee presents the ticket bearing their name on the front. Where, in the case of a permitted assumption of the event contract and the associated transfer of the ticket, a name has already been entered, that name must be crossed out and the name of the person assuming the contract entered in the available space on the front of the ticket, without obscuring the barcode.

9.3. Proof that the attendee is a contracting party with the event organiser and has therefore acquired the right of attendance shall be established by presentation of the ticket and — at the event organiser's request — a photographic identity document. The event organiser reserves the right to refuse admission to ticket holders who have not acquired a right of attendance, in particular by cancelling the ticket. Where the event organiser grants admission to a ticket holder, it shall be discharged from its obligations to the contracting party even where the ticket holder is not the contracting party or does not hold a right of attendance. Each right of attendance entitles one person only to attend the event.

9.4. The purchaser may only transfer their rights and obligations under the event contract (including the right of attendance) to a third party by way of a full assumption of the event contract by that third party, who shall assume all rights and obligations thereunder in place of the purchaser. Such assumption requires the consent of the event organiser, which is hereby granted in advance subject to the restrictions set out in Clause 9.5. The transfer of individual rights arising from the event contract, in particular the right of attendance, is excluded unless the third party simultaneously assumes all rights and obligations under the event contract with the consent of the event organiser. Where a contracting party has lawfully acquired multiple rights of attendance under a single event contract and lawfully transfers those rights to multiple third parties by way of contract assumption, separate event contracts shall be concluded with each of the persons assuming the contract.

9.5. In order to prevent the resale of tickets at inflated prices and to guard against the risk of criminal offences in connection with attendance at events, the event organiser's consent to the assumption of the event contract by a third party pursuant to Clause 9.4 shall not be granted in the following circumstances:

  • Where tickets are sold by the customer or by third parties and the resale price exceeds the amount paid by the customer for the ticket in question — including any charges such as booking fees, handling fees, service charges, and postage — plus a flat rate of EUR 5.00, by more than 10%; this applies in particular to private transfers;
  • Where tickets are sold by the customer or by third parties via auction (including online auctions);
  • Where tickets are sold by the customer or by third parties via online marketplaces or online ticket exchanges;
  • Where tickets are sold on a commercial or business basis without the prior express written consent of the event organiser;
  • Where tickets are transferred, whether for consideration or free of charge, for the purposes of advertising, marketing, as a bonus, promotional gift, prize, or as part of a hospitality or travel package, without the prior express written consent of the event organiser;
  • Where tickets are knowingly transferred to persons who have been banned from the event premises.

9.6. The resale and transfer of tickets in breach of Clause 9.5 is prohibited. The same applies to the offering of tickets for sale or transfer where the corresponding transaction would constitute a breach of Clause 9.5.

9.7. For each breach of the prohibition set out in Clause 9.6, the customer shall be liable to pay a contractual penalty to the event organiser, the amount of which shall be determined by the event organiser at its reasonable discretion and which may be reviewed by the competent court in the event of a dispute, provided that it shall not exceed EUR 2,500.00 per breach. The number of breaches shall be determined by the number of tickets unlawfully offered, resold, or transferred. Any other contractual penalties shall be taken into account when determining the amount of the penalty. Claims for damages by the event organiser shall remain unaffected, with contractual penalties being credited against any claims for damages arising from the same set of circumstances.

9.8. In the event of a breach of the prohibition set out in Clause 9.6, the event organiser shall be entitled, in addition to claiming a contractual penalty and, where applicable, damages, to withdraw from the event contract and/or to cancel the ticket and refuse admission to the ticket holder. Where the customer is entitled to a refund as a result of the withdrawal or cancellation, the event organiser may offset this against the contractual penalty.

9.9. In the event of a breach of the prohibition set out in Clause 9.6, the event organiser shall be entitled, without prejudice to its freedom of contract, to exclude the customer from purchasing tickets in the future.

9.10. In the event of the resale or transfer of a ticket, the customer shall, upon request by the event organiser, be obliged to provide the name and address of the recipient of the ticket within 14 days.

9.11. Where the customer fails to fulfil their obligation under Clause 9.10 within the stipulated period and, as a result, the event organiser is unable to claim a contractual penalty from the recipient or a subsequent transferee in respect of a breach of the prohibition set out in Clause 9.6, the event organiser shall be entitled to claim a contractual penalty from the contracting party. The amount thereof shall be determined by applying Clause 9.7 mutatis mutandis, with due regard to any other contractual penalties, and may be reviewed by the competent court in the event of a dispute.

9.12. Where we act on behalf of another event organiser, we are entitled, by virtue of our position as the event organiser's agent, to exercise the rights of the event organiser set out in this Clause 9 on their behalf and in their name.

9.13. Clauses 9.1 to 9.12 also apply to subscription passes and their transfer for one or more events. In the event of a permitted transfer, the recipient shall, in accordance with Clause 9.4, assume the subscription contract in respect of the events for which the subscription pass is transferred. The transfer shall be effected in the same manner as for an individual ticket, i.e. the name of the original holder must be crossed out and the name of the person assuming the contract entered in the available space on the front of the pass, without obscuring the barcode. The permissible surcharge for subscription passes in the case of a permitted transfer by way of contract assumption pursuant to Clause 9.5, first indent, shall be calculated on the basis of the total subscription price divided by the number of events covered by the subscription for the relevant season.

10. Purchase Under a Third-Party Name or Through Agents, Contractual Penalty

10.1. The purchase of tickets under a false or third-party name, in particular by operators of online ticket platforms, is prohibited.

10.2. The event organiser shall be entitled to withdraw from the contract where a ticket has been purchased in breach of the prohibition set out in Clause 10.1 and the contract was initially concluded without the event organiser's knowledge of the breach.

10.3. The purchaser of the ticket shall furthermore be liable to pay a contractual penalty to the event organiser for each breach of the prohibition set out in Clause 10.1, the amount of which shall be determined by the event organiser at its reasonable discretion and which may be reviewed by the competent court in the event of a dispute, provided that it shall not exceed EUR 2,500.00 per breach. The number of breaches shall be determined by the number of tickets purchased under a false or third-party name.

10.4. Where the customer is entitled to a refund as a result of the withdrawal pursuant to Clause 10.2, the event organiser may offset this against the contractual penalty pursuant to Clause 10.3. Any other contractual penalties shall be taken into account when determining the amount of the penalty. Further claims for damages shall remain unaffected, with contractual penalties being credited against any claims for damages arising from the same set of circumstances.

10.5. Where we act on behalf of another event organiser, we are entitled, by virtue of our position as the event organiser's agent, to exercise the rights of the event organiser set out in Clauses 10.1 to 10.4 on their behalf and in their name.

11. Concessions, Verification of Details

11.1. Attendance at an event at a concessionary price is only permissible where the relevant entitlement to a concession still subsists on the day of the event. Proof of entitlement must be produced to the admissions staff upon request. Where such proof is not produced, admission shall only be granted upon payment of the difference between the concessionary price and the full ticket price. The combination of concessions (e.g. a student discount and a disability concession) is not permitted.

11.2. Where the entitlement to a concession does not yet exist at the time of concluding the contract but is subsequently acquired, no right to a retrospective concession or to withdrawal from the contract shall arise. The same applies where an event organiser introduces or offers new concessions at a later date.

11.3. Upon receipt, the customer is obliged to check the tickets promptly for accuracy with regard to quantity, date and venue of the event, start time, concession, etc., and to raise any complaints without delay. Where a ticket is purchased at a box office, it must be checked immediately on the spot. The same applies to the confirmation e-mail sent to the customer, which must also be checked promptly upon receipt for accuracy of the details. Complaints regarding tickets not purchased on site may be submitted by telephone via our hotline or by e-mail. Our hotline number and e-mail address are set out in Clause 1.1.

12. Cancellation, Postponement and Alteration of Events

12.1. The event organiser reserves the right to cancel or abandon an event in the event of force majeure (including in particular severe weather, earthquake, flooding, fire, war, strike, or operational disruptions caused by external factors such as power failure), where the competent public safety authorities advise against holding or continuing the event or prohibit it owing to the risk of a terrorist attack, or where a performer is unable to attend due to illness, incapacity, or death and no suitable replacement is available or where cancellation is appropriate out of respect for the deceased. In such cases, the customer shall receive a full refund of the ticket price or, in the event of an abandoned event, a pro-rata refund. Further claims by the customer shall be excluded where the event organiser is not responsible for the cause of the cancellation or abandonment. The event organiser's statutory rights to cancel or abandon an event shall remain unaffected.

12.2. The event organiser reserves the right, in the event of a performer's incapacity, illness, or death, to make a substitution and/or programme change at its reasonable discretion, or to relocate or reschedule the event on grounds set out in Clause 12.1 at its reasonable discretion, provided that such changes are reasonable in the circumstances, taking into account the interests of the event organiser. In such cases, the customer's rights of withdrawal and price reduction shall be excluded. The event organiser's statutory rights to postpone or alter an event shall remain unaffected.

12.3. The event organiser reserves the right, even after conclusion of the contract, to assign the customer an alternative seat at its reasonable discretion where the seat specified on the ticket is unavailable (e.g. due to a defect) and where such reassignment is reasonable in the circumstances, taking into account the interests of the event organiser. In such cases, the customer's rights of withdrawal and price reduction shall be excluded. The event organiser's statutory rights to reassign seating shall remain unaffected.

13. Liability

13.1. The event organiser's liability for loss of life, personal injury, or damage to health that does not result from a culpable (i.e. intentional or negligent) breach of duty on the part of the event organiser or its legal representatives or vicarious agents is excluded.

13.2. For losses other than those arising from loss of life, personal injury, or damage to health, the event organiser shall only be liable where such losses result from intentional misconduct or gross negligence on the part of the event organiser or its legal representatives or vicarious agents. Where, however, losses arise from a breach of a material contractual obligation (i.e. an obligation whose fulfilment is essential to the proper performance of the contract and upon compliance with which the contracting party regularly relies and is entitled to rely), the event organiser shall be liable for any degree of fault, but in the case of ordinary negligence, liability shall be limited to the foreseeable loss typical for this type of contract.

13.3. Liability under the Product Liability Act, which governs the liability of a manufacturer in respect of its products, shall not be affected by Clauses 13.1 and 13.2.

13.4. The provisions of Clauses 13.1 to 13.3 shall apply mutatis mutandis to the liability of the event organiser's vicarious agents and legal representatives. They shall also apply mutatis mutandis to our own liability and to the liability of our vicarious agents and legal representatives.

13.5. The burden of pleading and proof shall not be affected by this Clause 13.

14. Wheelchair Users

Spaces are available for wheelchair users. Entitlement to an accessible space only arises where the relevant requirement has been notified prior to the purchase of a ticket and the event organiser or we, acting as their agent, have confirmed that such a space is available.

15. Right of Withdrawal

The customer may not withdraw from their declaration of intent to conclude the contract, as no right of withdrawal exists pursuant to Section 312g(2), sentence 1, no. 9 of the German Civil Code (BGB). Tickets are therefore excluded from return.

16. Data Protection

16.1. Contact details: We are the data controller within the meaning of Article 4(7) of the General Data Protection Regulation (GDPR). Our address and contact details, as well as those of our Data Protection Officer including their e-mail address, are set out in Clause 1.1.

16.2. Purpose of processing and legal basis: Where the purchase of a ticket or subscription requires the customer to provide personal data (hereinafter "data"), such data shall be processed for the purposes of concluding and performing the contract (including the enforcement of legal claims and debt collection) on the basis of the applicable data protection legislation, in particular Article 6(1)(b) GDPR. Data shall furthermore be processed on the basis of the applicable data protection legislation in pursuit of the event organiser's legitimate interests (in particular Article 6(1)(f) GDPR). Such legitimate interests consist — subject to the provisions set out below — in preventing the event organiser or third parties from suffering financial loss, and in communicating product information to the customer.

16.3. Categories of data: The following categories of data are processed: master data (such as name and address), communications data, contract and order data, claims data, and, where applicable, payment and default information.

16.4. Third-party recipients: Data shall also be shared with third parties (e.g. event organisers, service providers) for the purposes of performing the contract. Data may furthermore be transmitted — including prior to conclusion of the contract — in compliance with the applicable legal provisions to credit reference agencies such as SCHUFA, in order to prevent the event organiser or third parties from suffering financial loss; for example, for the purpose of obtaining probability values relating to the risk of default, or for the transmission of undisputed or legally established claims of the event organiser in respect of which the customer is in default. Credit reference agencies also store the data transmitted to them in order to make it available to their affiliated contractual partners for the purposes of assessing the risk of default. Such disclosure of data shall only occur, however, where the affiliated contractual partners of the credit reference agency can demonstrate a legitimate interest in the transmission of the data. The credit reference agency may disclose address data for the purpose of tracing debtors. The customer may obtain information from the credit reference agency regarding data stored about them. In the course of debt collection, data may be transmitted to the following categories of recipients where necessary for the recovery of the debt: assignees, credit reference agencies, debt collection agencies, third-party debtors, residents' registration offices, courts, bailiffs, and solicitors. In the event of a breach of the provisions of Clauses 9.6 and 9.10 (unauthorised transfer and failure to disclose the recipient's identity) and Clause 10.1 (purchase under a false or third-party name), data may also be disclosed to third parties who require it for the legal prosecution of similar breaches, such as a trade association responsible for combating unfair competition.

16.5.

Product information: Data shall be used, on the basis of the applicable data protection legislation (in particular Article 6(1)(f) GDPR), to send the customer information about other services offered by the event organiser, whether by post or — in compliance with Section 7(3) of the German Act Against Unfair Competition (UWG) — by electronic means.

16.6. Data retention period: Data shall be deleted promptly where there is an obligation to do so, in particular where the data is no longer required for the purposes for which it was collected and no statutory retention obligations apply. Independently of this, a review shall be carried out every three years to determine whether deletion of the data is possible.

16.7. Customer's right to object: The customer may object at any time to the processing of their data for the purpose set out in Clause 16.5 by notifying the event organiser accordingly. The customer also retains the right to object, pursuant to Article 14(2)(c) in conjunction with Article 21 GDPR, to processing carried out on the basis of Article 6(1)(f) GDPR.

16.8. Further rights of the customer: Subject to the applicable statutory conditions (in particular the GDPR), the customer shall have the following rights: the right of access, rectification, erasure, restriction of processing, and data portability. The customer may also lodge a complaint with the supervisory authority regarding the processing of data relating to them. The address of the supervisory authority with jurisdiction over us is: Die Landesbeauftragte für den Datenschutz Niedersachsen, Frau Barbara Thiel, Prinzenstraße 5, D-30159 Hannover, Telephone: +49 511 120-45 00, Fax: +49 511 120-45 99, E-mail: [email protected], Website: www.lfd.niedersachsen.de

17. Dispute Resolution

The European Union provides an online platform for out-of-court consumer dispute resolution at the following link: ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body. Should you have any queries, you are welcome to contact us at any time.

18. Governing Law and Jurisdiction

18.1 The laws of the Federal Republic of Germany shall apply exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

18.2. The German courts shall have exclusive international jurisdiction over disputes arising out of or in connection with the event contract where the customer concluded the contract for purposes relating to their trade or business, or where the customer was domiciled or habitually resident in the Federal Republic of Germany at the time of concluding the contract. In all other respects, the statutory rules on jurisdiction shall apply.

18.3. Where the German courts have international jurisdiction and the customer was a merchant (Kaufmann) at the time of concluding the contract, the courts of the district in which we have our registered office shall have exclusive local jurisdiction. In all other respects, the statutory rules on jurisdiction shall apply.
